Patients with severe hearing loss filed a class-action lawsuit against Advanced Bionics Corp. and Astro Seal, Inc. for manufacturing and marketing defective prosthetic hearing devices called cochlear implants, the lawsuit states. Two law firms are representing patients in the lawsuit - attorneys from Hagens Berman and Classman, Edwards, Wade & Wyatt, P.C.

People with profound hearing loss use cochlear implants to capture useful hearing sensations. Unlike hearing aids, cochlear implants are electronic hearing devices that selectively process sound through a miniature computer processor worn outside the body. These signals are then transmitted wirelessly to an implantable cochlear stimulator that is surgically implanted into the patient.

Advanced Bionics, a maker of high-tech medical devices, produced cochlear implants that were prone to moisture damage and hardware failure, the lawsuit states. Recipients of these defective implants claim they underwent implantation surgery and extensive hearing recovery and rehabilitation therapy before discovering there was no improvement to their hearing. Many patients required multiple corrective surgeries in an attempt to replace failed cochlear implant.

In 2009, Advanced Bionics reported the HiRes 90k cochlear implant experienced high hardware failures as a result of "feed-through assemblies" developed by Astro Seal, the lawsuit charges. Since then, Advanced Bionics has refrained from using feed-through assemblies from the vendor.
