Hagens Berman Sobol Shapiro has filed a proposed nationwide class-action lawsuit against Menu Foods on behalf of pet owners and pet food consumers, alleging the company's dog and cat food caused an unknown number of pets to become ill, and many of them have died.
The suit, filed in U.S. District Court in Seattle, seeks to represent hundreds of individuals who have suffered the economic and emotional loss of a pet as a direct result of the defendant's product.
According to the complaint Menu Foods has recalled 50 brands of dog food and 40 brands of cat food all of the 'cuts and gravy wet' style. Among the many brands Menu Foods produced are Iams, Eukanuba and Science Diet and all were distributed at retailers nationwide including Wal-Mart, Kroger and Safeway.
The suit alleges that the pet food produced by Menu Foods was not safe for pets to consume and caused cats and dogs to become ill. The unsafe nature of the pet food constitutes a breach of contract and as a direct result the named plaintiffs and class members suffered damages. To view the filed complaint please click here.
