Date Filed: December 22, 2009 Court: U.S. District Court Location: California
Hagens Berman served Skyline Homes, Inc. with a class action lawsuit on behalf of homeowners for allegedly failing to provide proper water protection for its line of manufactured homes. According to the complaint filed in the U.S. District Court of Eastern California, Skyline Homes designed, built and sold manufactured homes without adequate weather-resistant barriers on exterior walls.
Homeowners of Skyline's manufactured homes claimed to have experienced moisture-related problems including bugs, mold, mildew and rot due to the lack of weather-resistant sheets typically placed between the home's exterior walls and siding. This violates state and federal building codes for manufactured homes, which clearly regulates the design, construction and structural durability so that buildings can withstand normal elements and use. Skyline also guarantees manufacturing defects for at least 15 months, stating these defects will be corrected without charge and within a reasonable timeframe.
Skyline failed to comply with state and federal building codes as well as neglected to uphold warranties for manufacturing defects, the suit contends.
