Hagens Berman Sobol Shapiro filed a class-action lawsuit against T-Mobile claiming the company's practice of charging consumers a late fee of $5 or 1.5 percent of the outstanding balance violates California consumer rights laws.
The lawsuit alleges, over the course of many years, T-Mobile wrongfully collected tens of millions of dollars by charging consumers late fees for any payment received after the due date specified on bills.
Plaintiffs allege T-Mobile's penalty fees charge customers substantially more than the damages actually caused by the customer paying late.
The lawsuit seeks to represent all California consumers who purchased a T-Mobile cellular plan and paid a late fee.
