Hagens Berman Sobol Shapiro today filed a class action lawsuit against Toys "R" Us, Inc., claiming the company conspired with several major manufacturers of baby products, including Peg Perego, Medela, Baby Bjorn and Britax, in anticompetitive agreements for the purpose of price-fixing, unreasonably restraining trade, and illegally maintaining and enhancing Toys "R" Us' monopoly power.

Specifically, the complaint claims Toys "R" Us and several baby product manufacturers violated provisions of the Sherman Antitrust Act by conspiring to inflate prices of high-end baby products, including car seats, strollers, high chairs, crib bedding, breast pumps and infant carriers.

The suit is asking the court to end what it claims are anti-competitive activities and seeks damages caused by the company's actions.

RECENT DEVELOPMENTS:

September 3, 2009 - Today the Third Circuit Court dismissed defendants' appeal to review the class-certification ruling we received in mid-July. The defendants appealed to the higher court after we obtained class-certification on July 15 in hopes of reducing the class and stalling the case further.

The road to class certification was a long one. After we filed our case in 2006, the court increased the plaintiff's burden in moving forward and imposed tougher requirements on the court in certifying the class. After years of hard work, we're happy to announce we can now move forward.

In mid-July, the court granted class certification, ruling that anyone who purchased one or more baby products manufactured by Britax Child Safety, Kids Line, Medela, Peg Perego, Baby Bjorn or Maclaren USA from Toys 'R' Us or Babies 'R' Us from 1999 to present is represented in this lawsuit.

We'll continue to update this case page as the case progresses. We anticipate the case will go to trial in early 2010.
