Hagens Berman LLP, as one of the counsel for the plaintiffs, has reached an agreement to settle a nationwide class-action lawsuit entitled Schiller v. Flowers Foods, Inc. The case was filed in Wake County, North Carolina, Superior Court on September 2004.
The plaintiffs' complaint, filed by Hagens Berman attorney Kevin Roddy, alleged that Flowers Foods failed to ensure the kosher status of certain pie shells manufactured between 2000 and 2001 at a former subsidiary of Flowers Foods located in Pembroke, North Carolina. The Pembroke plant ceased manufacturing in 2001. Flowers Foods no longer manufactures pie shells.
Under the terms of the proposed settlement, litigation will be terminated and Flowers will donate $1 million in cash and $1.5 million in bread products to charitable organizations.
On September 24, 2004, Judge Donald W. Stephens of the Wake County Superior Court granted preliminary approval to the proposed nationwide settlement. The settlement is subject to a number of conditions, including notice to class members and final court approval following completion of a fairness hearing, which is currently scheduled to be held on December 6, 2004 at 10:00 a.m. in Courtroom 10B at the Wake County Courthouse in Raleigh, North Carolina.
