Hagens Berman Sobol Shapiro filed a class action lawsuit against the United States Department of State (DOS) on behalf of all residents who paid for expedited passport services and didn't receive their passport in the guaranteed time or a refund for missed delivery.

The DOS offers an expedited passport service for an additional fee of $60. The expedited service requires the DOS to complete the process within three business days, beginning when the application reaches the passport agency.

The DOS regulations also state that the expedite fee 'will be refunded if the passport agency does not provide the requested expedited processing as defined.'

The complaint states that the recent changes in our country's border security, requiring all citizens of the U.S., Canada, Mexico, Bermuda or the Caribbean to present a passport when entering the U.S. by air, led to a flooding of applications in the system.

Since the initiative went into effect in 2007 the DOS received more than four million applications from December 2006 through February 2007 alone, of which half included an expedite fee.
