Date Filed: June 26, 2000
Court: Circuit Court
Location: Florida

Hagens Berman represented plaintiffs asserting claims against Rexall for violations of state and federal laws against unfair competition and false advertising in connection with Rexall's distribution and sales of Cellasene to consumers nationwide.

Rexall has agreed to pay up to $12 million dollars into a Consumer Redress Fund to pay refunds to consumers who purchased Cellasene

Recent Developments

April 6, 2005 - Hagens Berman Sobol Shapiro is a recognized leader for its protection of consumers through class-action litigation. Recently, Breast Cancer Action sent a brief letter to managing partner Steve Berman in appreciation of the firm's efforts in the Rexall Settlement.

In April 2004, the settlement and claims administrator mailed out checks to consumers who submitted valid and verified claim forms. If you submitted a claim form and have not received your check, you should call Gilardi & Company at (415) 461-0410 to inquire as to the status of your claim.

On Oct. 20, 2003, Judge Anthony Mohr of the Los Angeles Superior Court granted final approval of the proposed settlement, and on Oct. 24, 2003, Judge Diana Lewis of the Palm Beach Circuit Court also granted final approval. Cellasene purchasers have until Dec. 31, 2003, to submit their claim forms. We currently estimate that reimbursement checks will be mailed by the settlement administrator in Feb. 2004.
