Hagens Berman Sobol Shapiro filed a class-action lawsuit against Trex Company, Inc., claiming the nation's largest manufacturer of wood-alternative decking sells flawed products and fails to live up to its obligations to consumers when its products fail.
In the lawsuit, a Washington homeowner claims that his deck is exhibiting persistent dark spotting/mold. The homeowner claims Trex offered to replace the damaged boards but refuses to pay for associated labor costs. In exchange for the new materials, Trex asked for a signed release freeing the company from further liability. A California homeowner has made similar claims in the suit.
The lawsuit alleges violations of the federal Magnuson-Moss Warranty Act, a consumer protection regime; state consumer protection acts; and state sales laws.
