- 2022-2023 Nissan Rogue
HOW DO I KNOW IF I’M AFFECTED?
Drivers of affected Nissan Rogues report a strong gasoline smell filling the interior of their vehicle and the garage where the vehicle is parked. The defect frequently manifests almost immediately, within weeks of owners first driving their vehicles.
PCV SYSTEM DEFECT EXPLAINED
The PCV system in combustion engines controls the flow of gasoline and oxygen to the crankcase, which is the central component of the engine. The PCV in Nissan Rogue 1.5-liter KR15DDT 3-cylinder variable-compression turbocharged (VC-Turbo) engines is defective, allowing fuel to seep through porous rubber components and into the engine compartment where it then filters into the interior of the vehicle.
CONSEQUENCES OF EXPOSURE TO GASOLINE FUMES
Prolonged and even short-term exposure to high levels of gasoline can lead to serious health issues, including:
- Nausea
- Headaches
- Throat irritation
- Difficulty breathing
- Kidney damage
- Other permanent organ damage
WHAT NISSAN KNEW ABOUT THE DEFECT
Owners reported this defect to the National Highway Traffic Safety Administration (NHTSA), Nissan dealerships and public consumer forums. Attorneys believe Nissan was aware of the defective PCV system as early as 2022, if not before. Technicians at Nissan dealerships have allegedly informed customers that this defect is widespread, and that the automaker is aware of it, but Nissan has neglected to recall affected vehicles and has failed to provide owners with a suitable fix.
WHAT ROGUE OWNERS ARE SAYING ABOUT THE DEFECT CAUSING GASOLINE FUMES
Nissan Rogue owners report dizziness, headaches and nausea while operating their cars. While the total number of Rogues affected by this defect is not yet clear, attorneys believe that thousands of Nissan Rogues are impacted, and owners have filed numerous complaints with NHTSA detailing similar experiences:
- “The fumes are nauseating and cause headaches…After speaking with a service manager at Woodfield Nissan, he said that he’s had a few cars come in recently with the same problem.”
- “We bought our 2022 Rogue in September 2022, it now has around 5300 miles on it. In December, we noticed that every time we drive it, the inside of the car fills with gas fumes. The fumes are so strong that it gives us extreme headaches, dizziness and nausea. When we park the Rogue in our garage, it creates a strong gas smell. We are concerned that it could explode or cause a fire.”
- “I have experienced nausea and headaches with the smell. My oldest child has complained about the smell and making his head hurt. It is very concerning that my ATTACHED garage fills with gasoline odor and could continue into my residence. I am now forced to park my vehicle outside and can not have my two children in the vehicle…They [the dealership] then advised that Nissan is aware of this issue but does not have a fix at this time.”
- “When parked and off, or sitting in idle a major smell of gasoline is spewing out of the hvac system in the car. It makes me nauseous and major headaches. This can’t be safe to drive.”
YOUR RIGHTS AS A VEHICLE OWNER
Attorneys believe Nissan has violated consumer law by failing to recall affected Rogues and by failing to provide owners with repairs or replacement parts. We believe it is unacceptable for Nissan to neglect the safety of its own customers, and to allow a defect with health repercussions to go unaddressed.
HOW CAN A CLASS-ACTION LAWSUIT HELP?
Through a class-action lawsuit, individual consumers can collectively bring claims against large corporations that would otherwise have the upper hand, like Nissan. A class-action lawsuit seeks to level the playing field, bringing strength to collective action to change corrupt practices and negligent responses to customers. Though these measures do not bring immediate relief, they are a time-tested method of holding companies accountable for wrongdoing, including automakers’ failure to sell reliable vehicles to their customers.
