Hagens Berman Sobol Shapiro began an investigation into Morgan Stanley's 401(k) plans and whether or not company fiduciaries violated terms of the Employee Retirement Income Security Act (ERISA).

Recently Morgan Stanley announced its first quarterly loss in the 72-year history.

HBSS is looking into allegations that the company continued to offer company stock as a 401(k) plan investment for participant contributions when it was no longer prudent to do so. Company fiduciaries have a responsibility under ERISA law to monitor and advise plan participants on the current financial health of a company and which investments will be most sound.
