Hagens Berman Sobol Shapiro Cases

Trex Company Inc.

Date Filed: January 13, 2009
Court: U.S. District Court
Location: Tacoma
Ticker Symbol: TWP

Hagens Berman Sobol Shapiro filed a class-action lawsuit against Trex Company, Inc., claiming the nation's largest manufacturer of wood-alternative decking sells flawed products and fails to live up to its guarantee when its products fail.

In the lawsuit, a Washington homeowner claims his two-year old deck began degrading, cracking and rotting and is now unusable and unsafe for his family. The homeowner claims Trex offered to replace the damaged boards but refuses to pay for associated labor costs. In exchange for the new materials, Trex asks for a signed release freeing the company from further liability.

The lawsuit alleges Trex's warranty documents violate the federal Magnuson-Moss Warranty Act, a consumer protection regime.

Trex faced a similar lawsuit in 2000 that settled. The settlement included a provision that says Trex will pay for replacement costs in addition to the new product.

If you purchased or obtained Trex decking material from Aug. 1, 2004 until present, you can join this suit. You can also reach attorneys at trex@hbsslaw.com or (206) 623-7292.
