Hagens Berman Investigates New England Compounding Company for Safety Violations amid Meningitis Outbreak

Hagens Berman, a law firm with extensive experience in pharmaceutical fraud cases, is investigating allegations that New England Compounding Company (NECC) manufactured and sold tainted epidural steroid injections that are believed to have caused a lethal form of fungal meningitis.

NECC sold at least 17,000 potentially tainted steroid shots to 75 clinics in 23 states across the country, according to published reports.

According to the Centers for Disease Control (CDC), 245 people have developed fungal meningitis, stroke due to presumed fungal meningitis, or other central nervous system-related infections. There have also been two reports of joint infections. The FDA has also identified three possible cases of fungal infections cause by other medicines from NECC, including cardioplegic solution, commonly used during heart surgery. NECC's apparent indifference has reportedly lead to at least 19 deaths.

The House Energy and Commerce Committee and the Justice Department have both launched investigations into this matter.

Hagens Berman's team on this matter is led by Thomas Sobol, one of the nation's most well-respected lawyers specializing in pharmaceutical fraud.

"We believe that NECC's actions represent an extreme departure in policy from accepted manufacturing practices for these drugs," said Mr. Sobol. "If that is the case, the company should be held accountable to the fullest extent the law allows. The victims of the company's negligence deserve nothing less."

HBSS's Boston office focuses on investigating, litigating, and trying drug cases. For years, HBSS Boston has aggressively pursued pharmaceutical litigation, helping lead the litigation fight for a more responsible pharmaceutical and medical device industry.

HBSS works with individuals, for-profit and not-for-profit health insurers, consumer organizations, state Attorneys General, third-party payors, drug wholesalers and retailers, and other purchasers. In recent years, HBSS' aggressive pursuit of pricing settlements amounted to more than a billion dollars in gross settlement funds. In 2009, Thomas M. Sobol was part of a team that worked to successfully try a RICO fraud case involving the drug Neurontin to a $142 million jury verdict. Sobol was subsequently nominated for Trial Lawyer of the Year.
