WHAT’S THE ISSUE?
Hagens Berman’s consumer rights legal team filed a class-action lawsuit against Diageo, a global leader in the beverage alcohol industry, alleging that its worldwide top-selling tequila brands Casamigos and Don Julio are not “100% Blue Weber Agave” as marketed.
Casamigos is promoted as a “super-premium tequila brand,” with every bottle labeled “Tequila 100% Agave Azul.” Similarly, Don Julio is promoted as a “luxury tequila” and specifies on its website that its bottles contain “100% Blue Weber Agave.”
However, attorneys have uncovered evidence that Diageo’s tequila products allegedly have significant levels of cane and or other types of alcohol — rather than pure tequila — while consistently being sold at a premium. Plaintiffs argue that purchasers were misled by Diageo’s product marketing and would not have paid premium prices, or would have chosen not to purchase, had they known the truth about the ingredients.
ABOUT DIAGEO’S ALLEGED ‘ADULTERATED’ TEQUILA
Diageo is a global leader in the alcohol beverage industry with sales data showing its brands Casamigos and Don Julio are in the top five best-selling tequila products in the world. Diageo markets its products with claims such as “Tequila 100% Agave Azul” and “100% de Agave,” but lab-tested samples of the products suggest they violate U.S. and Mexican law.
According to the lawsuit, tequila that is labeled as 100% agave may not legally contain cheaper substituted alcohol such as cane or other types of alcohol that are not made from Blue Weber Agave.
Diageo has no exception to these requirements. Attorneys believe the company may have been tempted to “cut corners” during production while maintaining its misleading marketing claims. The lawsuit seeks damages for the premium prices consumers have paid.

100% BLUE WEBER AGAVE TEQUILA
Blue Weber agave, known for its unique blue-gray color, is the only agave species legally permitted under U.S. and Mexican law to be used in tequila production. Spirits made from 100% Blue Weber agave are sold at a premium because it takes an estimated 5-10 years to grow and is more difficult to harvest.
In early 2025, Mexican media reported that agave growers in Mexico demonstrated against tequila companies protesting the use of non-agave ingredients.
Other advocates have protested the lack of the tequila industry’s regulatory compliance and believe, despite supposedly being regulated by Mexico’s Tequila Regulatory Council, the nonprofit organization could be heavily influenced and controlled by the interests of leading tequila manufacturers.
