WHAT’S THE ISSUE?
Hagens Berman’s automotive legal team filed a class-action lawsuit against Ford Motor Company on behalf of Ford dealerships nationwide. The suit accuses the automaker of failing to fully reimburse its dealerships for warranty-covered parts and repairs, specifically with the replacement of electric vehicle (EV) batteries.
EV batteries are generally the single most expensive component of an electric vehicle, ranging up to $25,000 in the Ford Mach-E.
Ford is obligated to reimburse dealerships based on the markup of the prevailing retail price, but Ford is reimbursing dealers only a fraction of what they’re owed—in direct violation of New York law, according to the lawsuit.

FORD'S ALLEGED VIOLATION EXPLAINED
Ford has sold 240,000 electric vehicles in 2025, but recent reports state that Ford has faced a slowdown of EV sales, compounded by the end of the $7,500 EV consumer tax credit in September 2025.
The lawsuit states that Ford “appears to be trying to save money by not fully reimbursing battery replacements at retail prices,” leaving dealerships to pay the price.
One Ford dealer plaintiff has replaced 28 EV batteries since early 2024 and should have received approximately $22,600 per battery, or $632,000 total from Ford. Instead, Ford reimbursed the dealership a total of $16,800—only $600 per battery—leaving the dealer more than $615,000 short.
