Whistleblower Successes

The following are some of Hagens Berman’s recent (and publicly disclosed) cases under the False Claims Act and SEC/CFTC/IRS whistleblower programs.

Most of our cases with the Department of Justice, the Securities and Exchange Commission, the Commodity Futures Trading Commission, and the Internal Revenue Service are sealed or otherwise confidential. Several of our SEC and CFTC cases in particular will remain confidential in order to protect our whistleblower clients who wish to remain anonymous indefinitely.

Bank of America / Countrywide Financial (Settled)

False Claims Act

Hagens Berman represented former home appraisal manager Kyle W. Lagow, who blew the whistle on widespread fraud at Countrywide Financial. On Mr. Lagow’s behalf, we filed the first whistleblower lawsuit against Bank of America for mortgage fraud. Our case sparked an investigation culminating in the historic $1 billion settlement between the Department of Justice and Bank of America, for which our client was provided a significant award. more »

False Claims Act

Hagens Berman represented whistleblower Gregory Mackler, who challenged Bank of America’s fraudulent handling of the Home Affordable Modification Program (HAMP) meant to help millions of struggling homeowners. Our suit was settled as part of the more than $20 billion global mortgage settlement with the Department of Justice in 2012, for which our client was provided a significant award. more »

Amgen (Settled)

False Claims Act

Hagens Berman represented whistleblower Marshall S. Horwitz, M.D., Ph.D. in claims against Amgen, the pharmaceutical giant. The allegations provided by Dr. Horwitz helped the Department of Justice reach $762 million in criminal and civil penalties levied against Amgen, for which our client was provided a significant award. more »

US WorldMeds LLC (Settled)

False Claims Act

In May 2019, the Department of Justice announced that pharmaceutical manufacturer US WorldMeds LLC agreed to pay $17.5 million to resolve allegations it violated the False Claims Act through payment of kickbacks to physicians in violation of the Anti-Kickback Statute. The settlement was based in part on allegations brought by Hagens Berman’s client, one of two whistleblowers involved in the matter. more »

Medtronic (Settled)

False Claims Act

Hagens Berman litigated this declined False Claims Act on behalf of two whistleblower clients challenging medical device maker Medtronic, one of the world’s largest medical technology companies, for fraudulent adulteration, misbranding and off-label promotion of its biliary devices. The firm ultimately reached a settlement with Medtronic. more »

Sound Physicians (Settled)

False Claims Act

Hagens Berman litigated this case against Tacoma-based Sound Physicians, a company ultimately made to pay the United States government $14.5 million to settle our whistleblower lawsuit, alleging that Sound cheated the government out of millions of dollars by fraudulently “upcoding” its bills to Medicare. more »

Center for Diagnostic Imaging (Settled)

False Claims Act

In May 2010, Hagens Berman joined as lead trial counsel a qui tam lawsuit on behalf of two whistleblowers against Center for Diagnostic Imaging, Inc. (CDI), alleging that CDI violated anti-kickback laws and defrauded federally funded health programs by presenting false claims for payment. This case ultimately settled with an award to the whistleblowers. more »
