WHAT’S THE ISSUE?
Hagens Berman’s consumer rights legal team has filed a class action against Costco Wholesale Corp., manufacturer and seller of Kirkland Signature tequila, accusing the retailer of knowingly selling tequila that is not “100% Blue Weber Agave” as marketed. Costco labels its Kirkland Signature tequila as “100% DE AGAVE” and as “100% AGAVE AZUL.” However, attorneys have uncovered evidence that Kirkland Signature tequila allegedly contains significant levels of cane and or other types of alcohol — rather than pure tequila — while consistently being sold and marketed as a premium product. We believe purchasers may have been misled by Costco’s marketing of Kirkland Signature tequila, and may have considered purchasing similar products instead had they known the truth about the ingredients.
ABOUT COSTCO’S ALLEGED ADULTERATED TEQUILA
Costco promotes its Kirkland Signature tequila as a comparable product to other tequila options on the shelf, with customers paying between $18.69 and $48.99 per bottle. According to the label of its Reposado tequila, “This very special Reposado tequila is a blend of tequila rested in American & French oak using 100% Blue Agave. Salud!”
But according to attorneys, despite the promises of its label, Kirkland Signature tequila has been deemed to have been adulterated and is not made exclusively from Blue Weber agave sugars.

100% BLUE WEBER AGAVE TEQUILA
Blue Weber agave, known for its unique blue-gray color, is the only agave species legally permitted under U.S. and Mexican law to be used in tequila production. Spirits made from 100% Blue Weber agave are sold at a premium because it takes an estimated 5-10 years to grow and is more difficult to harvest.
In early 2025, Mexican media reported that agave growers in Mexico demonstrated against tequila companies protesting the use of non-agave ingredients. Other advocates have protested the lack of the tequila industry’s regulatory compliance and believe, despite supposedly being regulated by Mexico’s Tequila Regulatory Council, the nonprofit organization could be heavily influenced and controlled by the interests of leading tequila manufacturers.
