WHAT’S THE ISSUE?
Hagens Berman has filed a class-action lawsuit representing homebuyers financing the purchase of their home through Rocket Mortgage or Quicken Loans. Attorneys believe Rocket may have violated homebuyers’ rights and led to higher homebuying costs. Attorneys also believe Rocket may have violated the Real Estate Settlement Procedures (RESPA) Act through “steering” or deliberately directing business to Rocket Mortgage, even when it wasn’t in the homebuyer’s best interest. ABOUT ROCKET’S ALLEGED FRAUD
The proposed class action against Rocket accuses Rocket Homes of “steering” clients to certain home loans offered by Rocket Mortgage. “Steering” is defined as the practice of compelling homebuyers to use loans offered by Rocket Mortgage, even when those loans are more costly or have higher interest rates. Steering in real estate is an illegal influence on a client's decision by guiding them away from cheaper options.
YOUR RIGHTS AS A HOMEBUYER
Hagens Berman believes Rocket has possibly violated homebuyers’ rights under federal law, including under RESPA. RESPA states, “no person shall give and no person shall accept any fee, kickback, or thing of value pursuant to any agreement or understanding, oral or otherwise, that business incident to or part of a real estate settlement service involving a federally related mortgage loan shall be referred to any person.”
A “thing of value” is “broadly defined” under RESPA’s implementing regulation by the CFPB under “Regulation X,” and includes, among other things, “the opportunity to participate in a money-making program,” or more plainly put, the opportunity to do business with a consumer through a referral. Our legal team believes Rocket Mortgage has violated RESPA.
