Thirty-Eight Women Now Suing USC’s Former Gynecologist, Dr. George Tyndall, in Federal Class-Action Lawsuit


Prominent class-action firm says victims continue to speak out against Tyndall’s rampant sexual abuse to bring systemic change through justice


LOS ANGELES – The federal class-action lawsuit against Dr. George Tyndall, the former gynecologist at the University of Southern California (USC), continues to grow in strength and size as more victims of Dr. Tyndall’s rampant sexual abuse and harassment step forward to join the case, according to Hagens Berman.

The law firm representing 38 women against Dr. Tyndall filed another class-action complaint on July 13, 2018, in the U.S. District Court for the Central District of California, detailing new cases of molestation, flagrant abuse of power and systemic and repeated sexual abuse by the former USC gynecologist. One victim also details her oral and written complaints to USC supervisors at the student health center that went unheeded.

“The fact that victims of Dr. Tyndall’s examination room abuse complained to nurses and wrote letters to the student health center director – and yet USC let Dr. Tyndall continue to abuse students for decades – is horrifying,” said Steve Berman, managing partner and co-founder of Hagens Berman.

“One thing Dr. Tyndall didn’t account for was the strength in numbers of dozens of women armed with the power of justice and the law,” added Elizabeth Fegan, partner at Hagens Berman representing the proposed class of women against USC and Dr. Tyndall. “We intend to do everything we can to fight for both the protection and empowerment of each and every one of his victims through this class-action lawsuit.”

Why Class Action?

“Many of Dr. Tyndall’s victims might be curious about their legal options and what they can expect from a lawsuit,” Berman said. “A class-action lawsuit seeks to compensate all victims who suffered the same abuse, but it also seeks to push systemic change though a large, unified front.”

Systemic change in this case could mean changes to USC medical examination protocols, third party oversight of USC’s student health center, and clear reporting requirements when any medical staff receives a complaint or is witness to a breach of medical protocols – no matter how small.

Hagens Berman’s sexual abuse legal team has been vocal in the MeToo movement, filing a federal class-action case on behalf of actresses and professionals who were sexually harassed by Harvey Weinstein. Hagens Berman is also investigating the alleged sexual abuses by a physician who treated male student-athletes and others at Ohio State University.

08/27/18: Consolidated Complaint Filed

On Aug. 27, 2018, Hagens Berman, on behalf of the plaintiffs' executive committee filed a 141-page consolidated class-action complaint in order to streamline the lawsuit. The consolidated case for In Re: USC Student Health Center Litigation includes 51 total plaintiffs and an expanded fact section. This filing combines all of the firm’s previous filings, as well as those of other firms named to the suit’s leadership committee. This will be the operative complaint for the class action in federal court.

08/14/18: Cases Consolidated & Leadership Appointed

On Aug. 14, 2018, U.S. District Court Judge Stephen V. Wilson selected Hagens Berman to chair the committee prosecuting the lawsuit.

On June 22, 2018, the firm submitted documents proposing that the court consolidate the many filed cases against USC and Dr. Tyndall, in order to streamline the lawsuit. In consolidating class-action cases, the court routinely appoints leadership positions.
