Walmart advertises its Walmart Organic Marketside eggs as having been laid by hens “with outdoor access,” charging consumers higher prices for perceived improvements to the welfare of the hens. A recent investigation revealed that hens supplying these eggs do not actually have access to the outdoors, never stepping foot on soil in their lifetimes.

ABOUT THE FRAUD

Walmart’s private label egg supplier confines its laying hens to industrial barns without outdoor access. Upon investigation, there was not a single chicken outside on the grounds. Rather, the hens are kept inside enclosed structures, with their feet never able to touch soil or vegetation. The industrial barns have two parts: the central interior and the enclosed porches that run along the side. The porches, which purportedly provide outdoor access, are roofed and screened with raised flooring.

In addition, only a small number of the tens of thousands of laying hens housed inside each industrial barn—less than 1 percent of the flock—was visible inside these enclosed porches.  This is not outdoor access for the laying hens, which is what Wal-Mart sold to consumers at a premium price.
