WHAT’S THE ISSUE?

Hagens Berman’s consumer-rights attorneys filed a class-action lawsuit alleging potentially harmful levels of toxic heavy metals in Orgain protein powder products sold at Costco warehouse stores and Costco.com. A recent report revealed that Orgain protein powders may contain unsafe levels of heavy metals, including lead, cadmium, and arsenic, unbeknownst to consumers. Consumers who purchased the affected products may have rights through a class-action lawsuit.

WHICH PRODUCTS ARE AFFECTED?

The following products may be affected:

  • Orgain Organic Protein Powder, Vanilla Bean
  • Orgain Organic Protein Powder, Creamy Chocolate Fudge

HEALTH RISKS OF HEAVY METALS

Heavy metals are known to pose significant risks to humans, including arsenic, cadmium and lead. Exposure can lead to a wide variety of health concerns, including cancer; gastric and vascular disorders; liver, kidney and brain damage; miscarriages and reproductive disorders. Because heavy metals accumulate in the body over time, even very low-level exposure on a regular basis can be hazardous.

HEAVY METAL TEST RESULTS

In 2025, testing revealed detectable levels of heavy metals in the Orgain protein powders, and independent testing conducted by plaintiffs’ counsel confirmed the presence of heavy metals and found one sample’s lead level to exceed the safe harbor by approximately 674%.

Attorneys allege Costco inadequately tested or never tested these products for heavy metals and failed to disclose to consumers the possibility of their presence. Attorneys further allege that Costco customers were kept in the dark about the allegedly harmful levels of heavy metals in the affected products, as well as the potential health consequences they may face. This is of particular concern given that the affected products are marketed as healthy, nutritious, safe and are intended to be ingested

HOW CAN A CLASS-ACTION LAWSUIT HELP?

Costco allegedly failed to inform the public of the potentially harmful health impacts of consuming Orgain protein powders. Hagens Berman represents consumers who purchased the allegedly affected products under the impression they were safe and non-toxic. A class-action lawsuit seeks to level the playing field, bringing strength to collective action to change unlawful practices. Though these measures do not provide immediate relief, they are a time-tested method of holding companies accountable for wrongdoing.
